Refugee Matters – First Hearing and Appeal

For protection in Canada, you must be a Convention Refugee or a person in need of protection. You are considered to be convention refugee if you have a well-founded fear of persecution upon returning to your country of citizenship or country of legal permanent residence. The alleged persecution must be for one of the following five grounds: race, religion, nationality, membership of a particular social group and political opinion. You must demonstrate that your country is unable or unwilling to provide you with adequate state protection. You are a person in need of protection if you are at risk of cruel and unusual punishment or death. You maybe at risk of torture at the hands of the government agents or actions with which government agents were complicit. You must show that risk you fear is personalized. Permanent Residency

Express entry

This is a three-stage immigration process. Applicants must first submit an Express Entry form online. Then, Immigration, Refugees and Citizenship Canada (IRCC) assesses these potential applicants against specific eligibility criteria. Those who meet the eligibility criteria will be entered into a pool with other eligible candidates. And the last stage is, candidates whose profiles align with the identified needs of the government, as well as that of certain Canadian employers, will be issued an “invitation to apply” (ITA).

Sponsorship

If you are a Canadian citizen or Permanent Resident, you can sponsor a family member who is not a Canadian citizen or permanent resident to Canada. This can be your spouse, common law or conjugal partner, or dependent child? At Prudentia Law, we can assist you in sponsoring your family member. Note that both the sponsor and the sponsored person must meet certain requirements to qualify.

Permanent Resident Card

New permanent residents will automatically receive their new cards as part of the immigration process. Those who need to apply for a Permanent Resident Card fall under three categories which are: Applying for a first Permanent Resident Card; Replacing a lost, stolen, or expired Permanent Resident Card; Requiring urgent processing of Permanent Resident Card application. We can assist in your application for a permanent residence card. A Permanent Resident Card is required for all Canadian permanent residents wishing to re-enter Canada through a commercial carrier.

Citizenship

Visitor Visa

You may require a visitor visa to visit or travel through Canada. The application process for a visitor visa is complex and time-consuming. To apply for a visitor visa, applicants must complete an online application form, and pay the application fee. Work Permit

If you are foreign national and wish to work in Canada, you require a work permit. There are various kinds of work permits some of which are Temporary Foreign Worker Program; LMIA-Based Work Permit; Global Talent Stream (GTS) LMIA; LMIA-Based Work Permit under Provincial Nominee Programs (PNP); Bridging Open Work Permit (BOWP); International Experience Canada (IEC) Work Permit. Study Permit

Do you want to study in Canada? A study permit is required for a foreign national wishing to study at a Canadian educational institution. With an acceptance from a designated learning institution, you can apply for a study permit. Some important aspects of your application are: is your study plan consistent with your past education; can you financially support yourself in Canada and do you have enough money to cover your education fees; do you have sufficient ties to your home country and that you will return home once your studies are complete?
