Emergency Protection Order (EPO)
An EPO is granted when violent or threatening behaviour occurs between family members, there is evidence that immediate protection is necessary, and that family violence will resume or continue. EPO applications are usually made on ex-parte basis, without notice to the family member committing the family violence and can also be made by police on your behalf. At Prudentia Law, we provide urgent legal support such circumstances to the victim/claimant or the respondent.
Queen’s Bench Protection Order (QBPO)
A Queen’s Bench Protection Order can be obtained by someone in need of protection from a family member in a situation where the need may not be as urgent as the need for an EPO. The QBPO application must be made with notice to the family member. At Prudentia Law, we provide legal support such circumstances to the victim/claimant or the respondent.
Restraining Order
If you are afraid for your safety due to the actions of someone and wish to stop them from coming close to you or contacting you, you can obtain a restraining order. In situation of allegations of family violence, a restraining order is granted by the courts when the alleged violence does not meet the threshold for an EPO or a QBPO. Violence does not have to be proven if there is another solid reason for the order to be granted. Restraining Orders can be granted against other members of the community, not just family members. Separation agreement
Even though not a legal requirement in Alberta, a well drafted separation agreement will act as a legally enforceable contract between you and your spouse or common law partner when you decide to go your separate ways. We provide independent legal advice on separation agreements, and also assist in drafting appropriate separation agreements that take into consideration all your rights and interests.
